Fair Use & Acceptable Use Policy
Wilderness ISP (Pty) Ltd ("Wilderness ISP", "we", "us") is committed to complying with applicable legislation and to ensuring that all customers can use our network and the internet without interference or harassment from other users. This Fair Use & Acceptable Use Policy ("the Policy") is designed to help achieve those goals and forms part of your agreement with us.
By using any Wilderness ISP service, you agree to comply with this Policy and to remain responsible for any users of your Service. We may update this Policy from time to time by posting a revised version on our website at https://www.wildernessisp.co.za/. Your continued use of the Service after changes are posted constitutes acceptance of the amended Policy.
1. Scope
This Policy applies to all Wilderness ISP products and services, and in particular to internet (IP) services.
2. Fair Use and Network Management
Although our packages are uncapped, fair use applies so that all subscribers can enjoy a reliable service. Accordingly:
- We may establish reasonable policies, rules and limitations concerning the use of any service from time to time. You must comply with any bandwidth, data-storage and other limitations we impose in our reasonable discretion.
- We manage our network and services for security and to optimise efficiency for the benefit of all subscribers. This may include rate limiting (speed management), rejection or removal of spam, anti-virus mechanisms, protocol filtering and reasonable restrictions on use.
- We will manage bandwidth during peak periods to the best of our ability; however, the Service remains a best-effort service.
- We may limit the number or volume of emails sent in a given period.
- You may not create an unusually large or sustained burden on our network in a manner that impairs other subscribers' use — for example, continuous high-volume uploading or downloading intended to degrade others' access, or otherwise using the Service abusively in connection with any uncapped or unlimited package.
- You may not use the Service for unattended, automated operation designed to simulate activity or avoid inactivity disconnection, unless otherwise agreed.
- Unless you are on a business package that expressly permits it, the Service is for your own use. You may not resell the Service, charge others for its use, provide internet access or services to third parties, or run public servers (including mail, web, FTP, IRC, game or multi-user servers) over the Service.
Failure to comply may result in the Service being restricted, suspended or terminated in our reasonable discretion.
3. Prohibited Activities
General. You may not use the Service in any way that is unlawful; that incites criminal acts; that harms or interferes with our network or systems or those of any other provider; that interferes with others' enjoyment of their services; that infringes intellectual property rights; that publishes threatening, obscene, discriminatory or defamatory material or hate speech; or that constitutes abuse, a security risk or a violation of privacy.
Unlawful activities. The Service may not be used in connection with any criminal, civil or administrative violation of any applicable local, provincial, national or international law, treaty, court order, ordinance or regulation.
Intellectual property. You may not use the Service to reproduce, transmit, distribute or store any material that infringes the intellectual property, privacy or publicity rights of Wilderness ISP or any third party.
Threatening or harmful content. You may not host, post or transmit content that harasses or threatens the health or safety of others. For any hosting services we provide, we reserve the right to decline content we determine to be obscene, indecent, hateful, malicious, racist, defamatory, fraudulent, excessively violent or otherwise harmful.
Protection of minors. The Service may not be used to commit any offence against a child or to promote unlawful interaction with children.
Child sexual abuse material. The Service may not be used to produce, transmit, distribute or store child sexual abuse material. Suspected violations may be reported to us at admin@wildernessisp.co.za. We will report any discovered violation to the South African Police Service and take steps to remove or block access to such content on our systems.
4. Spam and Email Abuse
Spam and email abuse are prohibited. This includes, without limitation:
- sending multiple unsolicited messages or "mail-bombing" one or more recipients;
- sending unsolicited commercial email or bulk messages, including chain mail, petitions or donation requests;
- sending bulk messages without a reasonable opt-out mechanism, or continuing to message addresses that have opted out;
- using another site's mail server to relay mail without permission, or using another computer without authorisation to send or retransmit messages;
- falsifying header, sender or origin information, or otherwise masking the identity or origin of a message;
- using IP addresses you have no right to use, or harvesting or collecting responses from unsolicited messages;
- using redirect links in unsolicited commercial email, or posting to more than ten online forums or newsgroups in a manner likely to generate complaints;
- intercepting or interfering with email intended for third parties, or removing author attributions or legal notices;
- distributing or making available any tool designed to violate this Policy or any other provider's acceptable-use policy, including tools to facilitate spam.
5. Security Violations
You are responsible for the security of your systems and any machines that connect to the Service, including applying necessary patches and updates. You may not use the Service to interfere with, gain unauthorised access to, or violate the security of any system or network. Prohibited security violations include, without limitation:
- unauthorised monitoring, scanning or probing of any network or system, or interception of data or harvesting of email addresses;
- hacking, breaching or testing the security of any host, network or account without the owner's express authorisation;
- impersonating others, or deceptively obtaining third parties' personal information (phishing);
- using or distributing tools designed to compromise security (cracking tools, password guessers, packet sniffers, network probers), except for authorised, legitimate security operations;
- knowingly uploading or distributing viruses, spyware, trojans, worms, root kits, corrupted files or similar harmful software;
- transmitting pirated software;
- using manual or automated means to evade use limitations, or assisting others to breach the security of our network or any other provider's network.
6. Your Responsibilities
You remain solely responsible for the content of any material you post, host, upload, download, create, access or transmit using the Service. We are not responsible for material created on, or accessible via, our network, including content on third-party websites we may link to for navigation or information purposes. You must take prompt corrective action to remedy any violation of this Policy and to help prevent future violations.
7. Enforcement
A failure to observe this Policy is a material breach of your agreement and may result in a warning, or the limitation, restriction, suspension or termination of your Service. Where reasonably possible, we will give you notice of a violation and an opportunity to correct it. Where we reasonably believe the Service is being used in violation of this Policy, we may take any responsive action we deem appropriate, including:
- temporary or permanent limitation, restriction or suspension of your access to the affected service, without notice;
- termination of all agreements with you with immediate effect;
- billing you for any costs we incur as a result of the offending activity (including bandwidth, administration and downtime); and
- disclosing information relating to the offending activity as required in the circumstances.
We have no obligation to monitor content but may do so as necessary to comply with law or lawful requests, or to protect our network and our customers.
8. Incident Reporting
Any complaint regarding a violation of this Policy (other than copyright or trademark infringement claims) should be sent to admin@wildernessisp.co.za, with sufficient detail to assist us in investigating and resolving it.
